LEGAL TERMS AND CONDITIONS OF THE DRAW

  1. ORGANISER
    This draw is organised by Newgarden Spain S.L., with registered office at Avenida Francia 5-15, PI Las Salinas, 30840 (Alhama de Murcia), and is open to individuals over 18 years of age who are legal residents of Spain (except the Canary Islands), France (except Corsica), Italy (except Sicily and Sardinia), Germany, Belgium, Austria, and the United Kingdom.

  2. PURPOSE OF THE DRAW
    The purpose of the draw is to promote the Newgarden Spain S.L. brand, rewarding participants for their engagement with the NEWGARDEN website.

  3. TERRITORY AND ELIGIBILITY
    The draw is valid only in the following countries: Spain, France, Italy, Germany, Belgium, Austria, and the United Kingdom. Individuals over 18 years of age who are legal residents in any of these countries are eligible to participate.

  4. DURATION OF THE DRAW
    The draw will start on Saturday, 31 May 2025 at 00:00 hours and will end on Monday, 1 September 2025 at 10:00 hours. Entries submitted outside this period will not be accepted.

If, due to force majeure, it becomes necessary to postpone, modify, cancel or repeat participation on the website, this will be announced through the aforementioned site, granting such publication the same level of publicity as these terms and conditions.

  1. PARTICIPATION REQUIREMENTS
    To participate in the draw, participants must meet the following requirements:

  • All individuals over 18 years of age who are legal residents of Spain, France, Italy, Germany, Belgium, Austria, or the United Kingdom, regardless of their nationality, and who meet the conditions set out in these terms.

  • Participation is free of charge; no purchase of any product or payment of any fee is required to obtain the prize.

  • Each user may participate as many times as they wish, provided they do not use the same email address more than once.

  • Participation in the draw implies full and unconditional acceptance of these legal terms and conditions.

  • The use of fake profiles or profiles created specifically for participation, as well as any other form of fraud that alters the results of the draw and/or violates the principle of equal opportunities among participants, is not allowed.

  • Employees of Newgarden Spain S.L., their direct relatives, and individuals professionally connected to the organisation of the draw are not permitted to participate.

  1. DRAW MECHANICS
    Participants must complete the form with their personal data (email) on the NEWGARDEN SPAIN website and agree to subscribe to the newsletter. Once the participation period ends, the winner will be selected randomly using the APP SORTEOS application, which uses a random selection system.

  2. PRIZES
    The prize will consist of a LOLA 165 BATTERY lamp from Newgarden. The prize cannot be exchanged for cash or any other product or service. The sale or commercialisation of the prize is prohibited.

The prize will be delivered within a maximum of one (1) month from the announcement of the winner, by shipment to the address provided by the winner.

  1. WINNER ANNOUNCEMENT
    The winner will be announced on Monday, 1 September 2025 via email. Newgarden Spain S.L. will contact the winner to coordinate delivery of the prize. If the winner does not respond within 7 days, a new winner will be selected.

  2. SHIPPING COSTS
    Shipping costs for the prize will be covered by Newgarden Spain S.L., provided that the destination is within the countries listed in section 3. Newgarden Spain will not cover costs related to second shipments.

  3. DATA PROTECTION
    In compliance with current data protection regulations, Newgarden Spain S.L. informs that participants’ personal data will be processed for the purpose of managing their participation in the draw. For more information, participants may consult our privacy policy.

The winning participant will be required to provide the personal data strictly necessary to ensure delivery and enjoyment of the prize. The participant gives full and express consent for their data to be processed in strict confidence and in compliance with the applicable laws.

  1. ACCEPTANCE OF THE TERMS
    Participation in the draw implies full acceptance of these legal terms and conditions. Newgarden Spain S.L. reserves the right to modify these terms at any time for justified reasons, duly informing participants.

  2. APPLICABLE LAW AND JURISDICTION
    This draw is governed by the laws of Spain. Any dispute arising from it will be submitted to the Courts and Tribunals of the city of Murcia, in accordance with Article 52.3 of the Spanish Civil Procedure Act.
